By commissioning artwork from Mykhail, you (Client) agree to the following terms and conditions:Payment
⟡ A non-refundable deposit of 70% of the total commission fee is required upfront to begin work, unless otherwise agreed upon in writing.
⟡The remaining 30% balance must be paid in full before the Artist will provide the final deliverables and is recommended to be paid per check-in but is not required.⟡ Acceptable payment methods are: PayPal and GCash , payment details will be sent personally via invoice. All fees for processing payments will be covered by the Client.⟡ Kindly be aware that by completing this purchase, you affirm that you are the legitimate cardholder associated with the PayPal account utilized for this transaction. In the event of a chargeback initiated due to unauthorized use of the card, I, as the artist, hold no liability. Ensuring your authorization as the cardholder, or that you are a parent who responsibly monitors their child's use of your PayPal or credit/debit card, is your sole responsibility.Revisions
Two (2) rounds of minor revisions are included in the commission fee after initial sketch approval. More than the agreed revisions will cost an additional 10% of the original price for the commission and should be paid upfront.
⟡ Minor revisions include small adjustments to colors, lighting, composition etc. that do not significantly alter the overall concept.⟡ Major changes beyond the agreed scope, such as completely redrawing characters/elements or altering the direction, will be billed at 13 USD/hour or 720 Php/hour.⟡ Prices may vary based on the inclusion of additional characters and the complexity of the artwork. These aspects can be negotiated when requesting a commission.Rights & Usage
⟡ Kindly note that the Artist maintain the authority to decline your commission for reasons such as:
i. If the slots are fully occupied or the commissions are closed.
ii. If the commission exceeds the Artist’s current skill level.
iii. The requested subject matter is outside the artist's comfort zone or against their artistic principles.
iv. The artist is experiencing health issues or personal emergencies that prevent them from taking on new work.
v. The artist has a policy against certain types of commissions (Listed in the ‘will not draw’ section).
vi. The client's behavior is disrespectful, aggressive, or unprofessional.
⟡ The Artist retains full copyright and all reproduction rights to the commissioned artwork.⟡ Upon full payment, the Client is granted the right to use the final commissioned artwork for the intended and agreed upon purposes (Personal Use Only), as outlined in the commission description.⟡ Additional usages beyond the agreed scope require a separate extended license, to be negotiated.⟡ This agreement covers the rights for [personal/non-commercial] use only, unless otherwise specified.Cancellations & Refunds
⟡ If the commission is cancelled by the Client before any work begins, the deposit will not be refunded.
⟡ If cancelled after sketches are completed but before final artwork, 30% of the full commission fee is due.⟡ No refunds will be issued if the Client cancels after the final artwork is delivered.Turnaround Time & Deadlines
⟡ The Artist will provide an estimated timeframe for completion workload (around 2 to 3 weeks) based on complexity and current. This is a good faith estimate only.
⟡ While the Artist will make every effort to meet agreed deadlines, delays may occur due to unforeseen issues, illness, or other priorities taking precedence.Communication & Reference Materials
⟡ The Client must provide detailed written descriptions, reference images/materials to ensure the artwork meets expectations.
⟡ The Artist is not responsible for unsatisfactory results due to vague instructions or lack of provided references.⟡ Failure to provide feedback or approve phases in a timely manner may result in project delays or cancellation fees.⟡ When hiring the Artist for a commission, the client commits to undergoing three (3) progress reviews (Sketch, Line art & Flats, Rendering and Final Touch-ups) throughout the commission process to ensure mutual satisfaction. The Artist will await approval from both parties before advancing to the next stage. Once approved, no further alterations can be made to the preceding stage.Terms & Amendments
⟡ This contract constitutes the entire agreement and supersedes any prior agreements, written or verbal.
⟡ These terms are subject to change by the Artist at any time. The most current version will apply to all new commissions.⟡ Any modifications or exceptions must be agreed upon by both parties in writing.By submitting payment, you acknowledge you have read, understand, and agree to be bound by these terms and conditions.
